PRIVACY POLICY FOR PERSONAL DATA TREATMENT
THROUGH CCTV SYSTEM

With the following: Ferrazza Srl, located in Cornedo Vic.no (Vi) via Tezze di Cereda 8/C–D as legal representative, (a.k.a. Data Controller) here shows the personal data policy about the management and subsequent modalities of the data acquired through video surveillance tools – complying with what is stated in article 13 – EU Regulation 679/16 (GDPR). Related to the personal data that will be owned and managed by the Data Controller, it is specified as follows.
1. Definition of “personal data” and “subject”.
The “personal data” object of the treatment include the images (shared data) captured by the video surveillance system installed in some company’s areas. The “subject” is the physical person to whom the personal data refer, the subject is covered by the personal data protection regulations.
2. Personal data source and gathering modality through video surveillance.
The Data Controller informs that its personal data are managed through informatic and electronic tools, using video surveillance systems: the images are automatically captured whenever someone passes in front of the video surveillance cameras or accesses the surveilled areas.
The footage pertains to the necessary areas and for the surveillance needs and finalities – later listed – and in no case audio registrations and/or detections are made.
The Data Controller adopts the right safety measures to avoid unauthorised access, disclosure, modification or deletion of Personal Data. External cameras are active 24/7, while internal cameras are active only during night-time.
The live recorded pictures can be visualised: a) via remote control; b) through a monitor. The registration is made also during working time (for the external cameras) and are normally deleted within the next 24 hours from the recording, except for particular needs. The video recording and registration devices is held in a safe place. The relevant authorities can access the recorded images as well, after criminous or malicious episodes.
Proper signs will signal the presence of cameras inside and outside the Company perimeter, with a “simplified” version of the data treatment policy.
The Data Controller can access the recorded Data as well as other subjects involved in the company. The updated list of External Data Controllers is always available and can always be asked to the designated Company Data Controller.
3. Purpose of data treatment.
Personal data will be treated and managed, for the purposes here described, on an electronic level, in a way that the visual angle of the area to be protected is limited, with the following purpose: – protect the company’s and customers’ assets from illicits (theft, damages); – guarantee the safety on the working place of the employees (legitimate interest); – monitor the company’s and third parties’ moving vehicles, to understand the dynamics of accidents and damages to the structures.
The registered pictures can be used for direct controls and establish the dynamics of violations and crimes.
4. Legal Basis.
Personal Data will be treated on the rightful Data Controller’s legal base, in the limits of the regulations listed by the Authority designated for the protection of personal data on April 8th 2010.
5. Nature of the provision.
Data provision is optional, meaning that the Subject automatically accepts such data treatment in the moment it accesses the areas covered by video surveillance: the subject can refuse to provide images by not entering the cameras range of action.
6. Conservation of the Subject’s personal data.
The conservation time of the pictures acquired through video surveillance is 24 hours. The images can be kept for a longer period of time in case of particular occasions or in the case there is a specific investigational request by the judicial authority or law enforcement. After the conservation period, the Personal Data will be cancelled. Therefore, after such period of time the right to access, delete, correction and portability of the Data cannot longer be practiced.
7. Place of Data treatment and transfer.
Data are treated at the operative location of the Data Controller; they will not be disclosed, given, nor shared with unauthorised people. At the moment, no Subject’s data transfer outside the EU is programmed. Whenever a transfer to Extra EU countries is necessary, the service providers will be selected among those who can give the adequate guarantees, as per GDPR 678/16, article 46.
8. Your rights on the subject of personal data protection.
Based on the current regulations, you have the right to the following about your personal data:
a) the access; b) rectification; c) cancellation; d) treatment limits; e) sharing data to third parties of your choice, meaning you will receive them in a structured format and readable on an automatic device. You will also be able to share the data with another Data Controller, with no impediment, in any case that requires all of this according to the current regulations; f) to accept the concent cancellation for all data that are optional to the execution of obligations derived by contract or law requirements; g) to oppose whatever data treatment based on legit interests, unless the motivations for which we are compelled to operate such treatment surpass any prejudice about your data protection rights. The exercise of such rights lies under some exceptions to protect the public interest (e.g.: prevention or identification of criminous activities) and our interests. Should you exercise any of the before mentioned rights, it will be our duty to verify that it is a legit exercise and we will provide our feed-back according to the current regulations. Every request to exercise rights under articles 15-22, EU Regulation 2016/679 will be managed at the e-mail address info@ferrazzanet.com
9. Updates.
The current policy is updated on the website www.automazioneindustrialeferrazza.it or on demand at the e-mail address: info@ferrazzanet.com. The dedicated person has to periodically check for any update.
